Cancellation Policy for Boat Rentals

At Gypsea, we strive to provide the best experience possible aboard our charter boats. However, we understand that sometimes unforeseen circumstances may arise that require cancellation of a reservation. Below we detail our cancellation policy for various situations:

1. Cancellation policy due to bad weather:

The weather can be unpredictable. Therefore, we will not be able to make a decision regarding weather conditions until 24 hours before the start of the excursion.

 

In the event that weather conditions are adverse and prevent the contracted excursion from taking place on one of our boats, our policy will be applied as follows:

1.1

Alternative date or time:

An alternative date for the excursion will be sought. If this is not possible, an alternative itinerary will be offered for the same day, adjusting schedules if necessary.

If the duration of the excursion is reduced due to adverse weather conditions, an adjusted rate will be applied according to the new duration. In no case can it be decided to shorten the excursion on the fly, once it has started, meaning this will result in a reduction in the rate.

1.2

Alternative Routes:

Sometimes it happens that weather conditions are adverse for navigation only in a specific area of ​​the island.

If the original route is not viable due to weather, an alternative route will be offered based on availability and weather conditions, with no possibility for clients to choose the itinerary in which conditions are adverse.

 

In the event that clients decline this new itinerary offered due to weather conditions, they would not have the right to recover the amounts advanced to formalize the reservation.

1.3

Refund of Payments:

If an alternative date or route cannot be found, all payments made in advance will be refunded within 48 hours.

What do we consider adverse weather conditions?

Adverse weather conditions are those that either prevent the boat from leaving the port or prevent the excursion from being carried out with full guarantees of safety and comfort for our clients.

 

Adverse conditions include:

  • Strong waves are forecast, with wave heights greater than 1.5 meters in the area where the boat excursion takes place.

  • Strong wind forecast with speeds above 25 knots.

  • Heavy rain forecast for a period of time greater than 20% of the total duration of the excursion.

Weather conditions that are NOT adverse for navigation:

  • There is a forecast that it will be cloudy or there will be little sun.

  • There is a possibility of light rain for a period of less than 20% of the total excursion.

  • We are cold because we haven't read the instructions and we haven't brought warm clothes.

Weather forecasts in Ibiza are rarely correct. Many times there is a 100% chance of a storm and hail, and within 10 minutes the sun is shining and there is no trace of cloud all day. For this reason, we cannot cancel a reservation due to a bad forecast. The charter can only be canceled on the same day, if weather conditions do not allow us to have safe boarding and/or navigation.

 

To consider a day not good for sailing, there must be bad weather for at least 25% of the duration of the trip. If there are some light showers during the voyage, or the wind blows a little, the day will not be considered bad enough to stop sailing.

Common Sense Application:

We are committed to applying common sense and ensuring the safety and enjoyment of our customers at all times. In no case will we force the excursion to be carried out on a day when our clients will not fully enjoy our boats and our islands, showing the greatest possible flexibility in terms of itineraries, schedules and pick-up points.

2. Cancellation by the client:

2.1

Total Cancellation:

In the event that the client, due to any circumstances, including force majeure (illness, missed flight, flight cancellation, transportation strike, theft at home, etc.), could not celebrate the contracted excursion, or the rental, he would lose partial or totally amounts delivered as a deposit based on the following points:

 

  • More than 6 months in advance: 100% refund of the deposit given less 30% of the total reservation for management expenses (advertising, bank payment and return fees, boat blocking time, etc.). For example, if a deposit of 500 euros is paid to reserve a boat with a total price of 1,000 euros, and a notice period of more than 6 months is given, the total deposit (500 euros) will be returned minus 30% of the reservation value. (30% of 1,000 = 300 euros). Total refund 200 euros.

  • Notice between 6 months and 30 days from the contracted date: Loss of 100% of the amount delivered, even if the amount delivered is 100% of the rental value.

  • Notice with a period of less than 30 days: The client will be obliged to pay 100% of the total value of the rental rate, including additional budgeted expenses such as fuel, moorings, etc., even if they do not enjoy the contracted boat.

2.2

Partial cancelation:

Partial cancellation of the number of hours contracted for day-charter

In the event that the client has a contracted time slot and for any reason wishes to enjoy less time than the contracted time, the client will not have the right to any refund or reduction in the rental rate. You must pay 100% of all reserved boats, even if you do not use them, unless you notify of this reduction 15 days prior to the boarding date.

 

Partial cancellation of the number of hours contracted for overnight stays

In the event that the client has a contracted number of days and for any reason wishes to enjoy a shorter period than the contracted period, the client will not have the right to any refund or reduction in the rental rate. You must pay 100% of the reserved period, even if you do not use it, unless you notify of this reduction 60 days prior to the boarding date.

 

In the case of notifying within the necessary period, 60 days, a new rate will be applied in proportion to the days reserved. Normally for an original reservation of more days a lower price is offered, so by reducing the number of days it is possible that the price per day will change.

3. Cancellation by the ship owner:

Nuestra empresa gestiona una flota mixta de barcos en propiedad y barcos en gestión. Los barcos pertenecen a armadores que nos confían la gestión de las reservas de clientes. A veces esta gestión de reservas ni siquiera es en exclusiva, sino que trabajan con otras agencias de reservas como nosotros.

 

Por tanto en estos casos nuestra empresa actúa como intermediario, siendo la gestión del barco, el arrendamiento y los pagos enviados directamente a cargo del armador del barco. Puede suceder que un problema técnico limite la disponibilidad contratada. En ese caso o en cualquier otro en el que el barco no este disponible, el arrendador (el armador del barco) procedería a cancelar el contrato con devolución de la totalidad de las cantidades hasta el momento recibidas, y sin que corresponda al arrendatario ni a los demás pasajeros indemnización alguna por esta cancelación, reembolso de billetes de avión, etc.

4. Date Changes:

We are aware that when a trip is planned in advance, there will most likely be changes. At Gypsea we will always try to satisfy the needs of our clients in the best possible way.

 

  • Date changes confirmed at least 30 days in advance are free. For changes with less notice, a surcharge of 500 euros will be applied.
